From signed contract to settled in Hilton

Hilton is about 4 km south-west of our Myaree office, in Perth’s southern suburbs. Whether you have just had an offer accepted or you are about to put the house on the market, the conveyancing is what gets you from a signed contract to a registered change of ownership.

In WA the person running your settlement is usually a licensed settlement agent, also called a conveyancer, or a lawyer. We are the former. We prepare and check the settlement documents, handle the figures and lodge with Landgate, and if anything needs legal advice we will recommend you get it.

Hilton is close enough that a home visit to sign the paperwork is easy to arrange, including on weekends.

What is behind a Hilton sale

Hilton has a good spread of property types, from long-held family homes to strata villas. Long-held homes sometimes need title work, such as a survivorship application, before they can be sold.

  • Subdivided rear lots often share a driveway, which shows up on the title
  • Long-held homes sometimes need a survivorship application before they can be sold
  • If there is a tenant, the contract needs to deal with that
  • Strata information requested as soon as the contract is signed
  • Title searched and any issues raised early, not the week before settlement

How a Hilton settlement runs

One of the first things we do on any Hilton file is search the title. It tells us who the registered owner is and what else is recorded against the land, such as a mortgage, caveat, easement or notification.

Most of it is routine. When it is not, finding out in week one rather than the week before settlement gives everyone time to deal with it.

Your Hilton settlement questions answered

Can you give me legal advice about my contract?

We are settlement agents, not lawyers. If your Hilton contract raises something that needs legal advice, we will tell you and recommend you speak to a lawyer.

Who chooses the settlement agent?

You do. Buyers and sellers are each entitled to appoint a settlement agent or lawyer of their choice, and to change at any time. You do not have to use the one suggested by the real estate agent.

Can one settlement agent act for both the buyer and seller?

Only if both parties are given a written disclosure and consent. Many Hilton buyers and sellers prefer to have their own settlement agent.

Will my settlement agent come out to Hilton?

In most cases, yes. Hilton is a short trip from our Myaree office, so a home appointment to sign the paperwork can usually be arranged, including on weekends.
